USDT vs USDC: Who Survives MiCA's Stablecoin Rules?

MiCA requires 30-60% bank deposits, €200M daily payment cap, and EMT authorization. USDC is compliant. USDT faces delisting risk.

July 1, 2026, is the MiCA deadline. For stablecoins, it's existential.

Under MiCA's EMT rules, stablecoin issuers must hold 30% of reserves in EU bank deposits (60% for "significant" stablecoins), obtain EMT authorization, and accept a €200 million per day payment cap.

Circle's USDC already meets these requirements. Tether's USDT does not.

The MiCA Requirements

Reserve: 30% in EU bank deposits (60% for significant EMTs with >10M holders, >€5B market cap, or >€500M daily volume).

Authorization: EMT issuers must be authorized credit institutions or electronic money institutions in at least one EU state. Circle has an EMI license in Ireland. Tether has not obtained authorization.

Payment cap: Non-euro stablecoins face a €200M/day limit for payments.

Where They Stand

USDC: EMI license in Ireland, Treasury-weighted reserves, monthly Deloitte attestation. The reference implementation for MiCA compliance.

USDT: Dominant by volume but no EMT authorization, no full audit, opaque corporate structure. Several EU exchanges have already restricted USDT.

Market Impact

MiCA is creating a two-tier stablecoin market in Europe. Compliant stablecoins operate freely; non-compliant ones face delisting. Combined with the US GENIUS Act, 2026 is the year stablecoins become regulated financial instruments.
